1. General Information
1.1 Rossy Rewards + (hereafter know as «Rewards +») is a loyalty program for the Michael Rossy Ltée Organization and all its stores.
By becoming a member (defined below) in the «Rewards +» Program, you agree that you have carefully read, understood and accepted all the «Rewards +» terms and conditions (hereafter known as «Terms»). All registration, membership options and program benefits are offered at the sole discretion of the Michael Rossy Ltée Organization. For more details and information on our «Rewards +» program, please visit our online website at: www.rossy.ca.
1.2 By becoming a member to our «rewards +» program, you will be able to accumulate points which will be converted to discount vouchers to be applied against future purchases, and be given access to special offers / events and much more not available to non-members.
1.3 By registering in our «reward +» program, members are consenting and will be automatically enlisted into our online mailing list / newsletter as well. If you wish to opt out of this program, please make your selection in the appropriate box that asks you to opt out of our mailing list / newsletter during your enrollment process.
1.4 The Rossy organization, at its sole discretion, can terminate, alter, limit, suspend or modify the rewards loyalty program and / or the «Terms» at any time, in cases of, but not limited to: changes to applicable laws, changes in services provided by the Rossy organization or introduction of any new services. Any such changes will take effect after 30 days from the date on which you have been informed of such changes either through "My Account" online, or on the Rossy website directly (www.rossy.ca), via email or a combination thereof. If you do not accept these changes, you have the right to cancel your «rewards +» membership at no cost to you (please refer below for the cancelation process).
1.5 The Rossy Organization reserves the right to make any minor changes to its loyalty program and its «Terms» without providing you with prior notification, provided that these changes do not materially affect the client’s membership in a negative way. It is the member's sole responsibility to make sure to stay updated on the «Terms», where you will always find the latest version of these «Terms» on our website (www.rossy.ca)
1.6 The «Rewards +» program has no predetermined date, and may continue until such date that the Rossy Organization, at its sole discretion, designates as the termination date for the program.
1.7 The Rossy organization is proud to partner-up with both Salesforce and Summit Tech to help us navigate, maintain and ensure a secure and reliable program infrastructure for our new Loyalty program. Sales force is the driving platform that will collect, process and safeguard our clients information and loyalty points, their privacy policy for your read and review can be found at the following link Salesforce Privacy Policy: https://www.salesforce.com/company/legal/privacy/ and Summit Tech provides the technical infrastructure to securely process sales transactions as part of the Loyalty Program. However, all customer data remains under Rossy’s control and is governed by Rossy’s privacy policy (https://www.rossy.ca/en/privacy-policy/). Only authorized employees and service providers have access to personal information, and only to the extent necessary to achieve the purposes outlined in the policy. Security safeguards appropriate to the sensitivity of the data are used to ensure confidentiality. Data is retained only for as long as required to fulfill its purpose or comply with legal obligations. When no longer needed, data is securely destroyed or anonymized.
2. Clients Personal Information
2.1 Member's personal information will be collected, used and managed throughout this membership process in accordance with Rossy's privacy policy (put privacy policy link here). By agreeing to these «Terms» members are also agreeing to the terms of the privacy policy and each member undertakes to read and review those terms, as such, which may be amended from time to time.
2.2 All members are solely responsible for advising the Rossy Organization of any changes or corrections of their «rewards +» account information, including but not limited to, changes to, name, mailing address, telephone number, email address or any other required membership enrollment data by either emailing or calling customer service (listed below) or logging-in on our website (www.rossy.ca) and making the required changes yourself.

3. Membership Registration and Eligibility Criteria's
3.1 «Rewards +» membership is available to Canadian residents only. You must have a valid email account, Canadian address and telephone number. These Canadian residents must be considered over the age of majority in their jurisdiction of residence, or from 16 years of age who have consent of their parent(s), guardian or legal representatives, as applicable. The Rossy Organization reserves the right to request written confirmation of such consent. Membership is limited to natural persons only, who are acting in a personal capacity and not in the capacity of a company, trust, partnership or any form of entity. Rossy employees, directors and officers are all eligible for membership into our «rewards +» program, but may be excluded from certain promotions.
3.2 Therefore, by completing a membership registration, you are confirming you are over the age of majority (adult) by your local legislation in your province or territory of residence, or at least 16 years or older and have the proper consent of your parent(s), guardian or legal representative, as required, and that you have read and understand all these «Terms». Rossy employees, directors or officers confirm that they are still active within the Rossy Organization and that they have read, and understood the «Terms».
3.3 Your membership to our «rewards +» program has no monetary value and is personal, and as such, cannot be assigned, traded or otherwise transferred and is subject to these «Terms», rules and policies, which may be amended from time to time.
3.4 We apply a limit of one «rewards +» membership per person, telephone number and email address used during the enrollment process.
3.5 It is solely your responsibility, and a condition of your membership, that you keep all your contact details and email address up to date. Further, all members are responsible for maintaining the security of their data, for all activities that occur using their credentials and notify the Rossy organization immediately if they become aware of any unauthorized use of their credentials or personal data. Solely the member and not the Rossy organization will be responsible for any damages or losses arising from unauthorized use of a member's credentials or data or a member’s failure to comply with these provisions.
3.6 Any company, group, partnership or other entity who make commercial or bulk purchases are not eligible for the «rewards +» program, and any and all approved memberships must not make purchases be used for reselling or profit purposes.
3.7 The membership registration to our «rewards +» program is free of charge and no purchase is necessary to become a member.
3.8 To become a «reward's +» member, you must register through either our online website (www.rossy.ca) or via our Rossy APP, or a QR code at checkout where a membership can only be established by providing a valid telephone number registered to your Rossy online account which will serve as your client membership number. You must choose a strong password and members are responsible for maintaining their credentials private and secure. All your client credentials can be found on our website or APP site in "My Account" tab upon logging-in.
3.9 Any violation of Rossy's «Rewards +» program rules, proven or probable fraud, or non-compliance with our «Terms», inactivity on your account, provision of incorrect data or any act detrimental to the Rossy Organizations interests may lead to termination of, and / or affect your ability to participate in our «rewards +» program, including but not limited to, the adaptation of payment methods. If your participation in our program is cancelled, all points shown on "My Account" page will automatically be forfeited.
3.10 All decisions regarding the interpretation of these «Terms» shall be at the sole discretion of the Rossy Organization, and shall be final and binding in all respects, subject to applicable law.
4. Cancellation Membership
4.1 Any member who wishes to cancel their «rewards +» membership can do so either by emailing or calling our customer service line
(listed below), or by canceling directly through our website. Please note, cancelation can take up to 10 business days to cancel your «rewards +»account. Once cancelled, you will no longer have access to any promotions, offers, discounts, point...etc. offered solely to our members, and any future online purchases will be done through the regular guest check out process.
4.2 Cancelling your «rewards +» membership will not affect any other enrollment you may have within the Rossy organization, but if you so wish to opt out of all enrollments with the Rossy organization, you can do so by calling or emailing customer service or by logging in online. As stated earlier this process can take up to 10 business days to be completed.
4.3 If you choose to cancel your «rewards +» membership, any points which remain in "My Account" page will be forfeited.
4.4 The Rossy Organization reserves the right to, at its sole discretion and without compensation, to either amend, alter, withdraw or terminate the «rewards +» program, including but without limitation to, the «Terms» or any program benefits. Rossy may modify, in whole, or in part, all the following elements but is not limited to just these terms: - The eligibility conditions for becoming a member; the program registration process; administration and «Terms»; the nature of the «rewards +» program benefits and the manner in which they may be obtained; and certain corporate information appearing in these «Terms» and any other changes required or recommended under applicable laws. In any event that the «Terms» or any aspect of the «rewards +» program is suspended, changed or restricted, Rossy will provide its members with advance notice by posting both the old version and the revised version online on its website or by sending an email to the members email address in the "My Account" outlining the old and new versions of the changes being implemented, or a combination thereof. The change will come into force 30 days after it is announced, and a member's continued participation in the «rewards +» program following the notice period will constitute consent to the program. If a member does not agree to any such amendments, they may cancel their membership without cost or penalty within the 30 days’ notice period. Membership accounts can be terminated or suspended for the following reason, but not limited to just these: any non-compliance with these «Terms», due to any inaccurate or invalid account information or credentials, any attempts to deliberately assign or transfer of a member's rights, undermine or damage the website or operations of this «rewards +» program in any manner.
4.5 Michael Rossy Ltée reserves the right to adapt payment methods and / or terminate or restrict access to membership accounts which may include, but is not limited to, the following: abnormal frequency and / or high number of returns, clear intent to resell and / or make a profit by purchasing our products, multiple accounts or registrations or registrations of new accounts by previously suspended or terminated users. We also reserve the right to cancel orders made when shopping as a guest for these same reasons. If you feel that we have made a mistake in restricting or canceling your «rewards +» membership or an order you placed, please reach out to our customer service (details listed below) or write to us through our online website (www.rossy.ca).
4.6 Michael Rossy Ltée reserves the right, at its sole discretion, and without limitation, to suspend, cancel or even terminate the «rewards +» program should a bug, virus or any other cause beyond the reasonable control of the Michael Rossy organization corrupt in any way the security or proper management of the loyalty program.
4.7 In the event that the Michael Rossy Corporation or any of its affiliates becomes insolvent / bankrupt, it reserves the right to eliminate any and all loyalty points outstanding at that time to all its customers without prior notice.
5. Benefits, Points, Tiers and Vouchers
5.1 Welcome to the Rossy «rewards +» program offered by Michael Rossy Ltée. The program is designed to reward you, our loyal customers, by offering points on purchases that can be redeemed for discounts and other benefits. As a member, you may receive exclusive benefits, such as, but not limited to, free shipping for purchases in excess of an $$$ amount, early access to sales promotions and personalized discounts based on your loyalty tier level. All these benefits are subject to change as the Rossy organization sees fit, and will be communicated to you via your online program dashboard or via email.
5.2 Upon signing up into our «rewards +» program you will be given access to one-time special promotion vouchers and points to be determined solely by the Rossy organization, and not limited to just these special vouchers, with very specific expiry dates, as follows:
- A Welcome Offer: new members will receive 250 points plus a 10% voucher discount to be applied on their next purchase. This voucher will have a 30-day expiry term from the date of issuance.
- A Birthday Offer: celebrate your birthday with a 10% discount voucher to be issued during your birthday month only, this offer will have a 7-day expiry term from the date of issuance.
- An Anniversary Offer: celebrate your membership anniversary and receive 250 points.
- A Special Threshold Offer: earn 10.00$ off purchases of 100.00$ or more within 30 days of the activation of your «rewards +» membership, to be used within that 30-day period.
- Refer a Friend Offer: where you refer a friend and they register to our «rewards +» program, upon making their first purchase of 25$ or more, you will receive 500 points.
- Flash Promotions: special promotions offering bonus points or discounts on specific dates and / or times, subject to availability and communicated through the «rewards +» program portal or via email, or a combination thereof.
Rossy reserves the right, at its sole discretion, to modify the amounts and contents of these special vouchers as it sees fit.
5.3 All vouchers can take the form of either:
- A dollar $$$ based vouchers,
- A % percentage off type discount vouchers,
- A product specific based vouchers (discount to be applied against certain items only).

5.4 By being a «rewards +» member you will be able to earn points on all eligible purchase made at our Rossy stores or online at out Rossy website (www.rossy.ca). members will earn 5 points per 1.00$ spent on eligible purchases, where eligible and ineligible purchases are defined as:
- An eligible purchase: includes all regular merchandise available in-store or online at our rossy website,
- A non-Eligible purchase: include gift card (if you purchase a gift card), any applicable taxes on purchased items, shipping charges and any non-qualifying items as determined by the Rossy organization at its sole discretion.
5.5 All points earned on a qualified purchase are held in escrow for 30 days after the purchase date. This 30-day escrow period is to ensure that points are not awarded and then items are returned within the Rossy return policy period. All returned items within the allowed Rossy Return policy period will automatically result in a claw back of any awarded points from that purchase. Any discount vouchers used to buy the returned items will be forfeited and lost. For all exchanges for a similar item, this process will not generate any new points being awarded nor will it result in any points being clawed back.
5.6 All points will expire, if not used or there is inactivity for 2 years (24 consecutive months) or more in your online account (i.e.: no purchase or redemption of any kind either in-store or online is made), your account will be deactivated, and any unused points, vouchers or benefits of any kind will be forfeited. If you attempt to log-in after the 2-year mark, you will have to re-enroll into the program as you would a new user.
5.7 All points will automatically redeem once they reach the 1,500-points threshold level, and a 5.00$ discount voucher will be generated and held in your account to be applied to your next purchase at Rossy. This discount voucher will have a 90 day expire term from date of issuance.
5.8 Stacking (combining) of points and vouchers is permissible for redemption purposes only, however promotions cannot be stacked or combined (i.e.: you cannot combine two % Percentage off offers in a single transaction)
5.9 A purchase of a Rossy gift card will not be eligible for points, but purchases made with the use of a Rossy gift card will generate the points for that transaction.
5.10 Any refunds awarded after the 30-day Rossy refund Policy period has elapsed will be in the form of voucher (valid for max of 90 days from issuance). The points for that refunded transaction will not be reissued, and as such are forfeited.
5.11 It is a member’s sole responsibility to continuously monitor their membership page to make sure that there are no pending discount vouchers or benefits that they are entitled too that may be expiring soon. The Rossy organization to the best of its ability will send out emails, post notices on the members dashboards, or a combination thereof, reminding them of their points balance, benefits and discounts that maybe coming to expiry.
5.12 No points or vouchers or any other form of benefits derived from the «rewards +» program can be redeemed for cash, and nor can redemption of any vouchers or other benefits be applied retroactively to previous purchases either in-store or online.
5.13 No points or vouchers or any other form of benefits derived from the «rewards +» program can be redeemed when buying an item on Layaway, Points will be awarded only at final payment when the goods are paid off and closed at the cash register by a Rossy employee and the merchandise is given to the client. No discount vouchers can be used to reduce the purchase price of any merchandise being bought on layaway terms.
5.14 All % discount vouchers received are applied to the subtotal amount before sales taxes, shipping and / or handling fees, and only 1 voucher at a time can be used on an invoiced purchase and can NOT be combined with any other transaction discounts at the point of sale (POS). Each discount voucher applied must have a valid code printed on it.
6. Redemption Rules:
Discount % VOUCHERS received from the loyalty program are treated as a regular transaction discount and will be applied to the subtotal amounts, before taxes / shipping / handling charges.
Dollar $ VOUCHERS received from the loyalty program will be treated as a dollar tender and will be applied to the total amounts, after taxes / shipping / handling charges.

- Dollar $ Vouchers:
- Customers can redeem 1 or more dollar $ Vouchers received from our loyalty program in one transaction
- Discount %-Vouchers:
- ONLY ONE Discount % Voucher received from our loyalty program can be used per transaction
- Discount % Voucher from our loyalty program can be used with our regular weekly flyer promotions (except where specific exclusions or disclaimers are mentioned on any given flyer and items on those flyers)
- Discount % Vouchers from our loyalty program cannot be used with any in store event or offers (ex: We pay the tax days, Senior discount days, Friends & family days, 10% to 75% store wide discount event days……but not solely limited to these events
- Dollar $-Vouchers & Discount %-Vouchers received from our loyalty program can be combined together on the same sales transaction, as such:
- ONLY 1 Discount % Voucher can be applied to the sales subtotal (before taxes/shipping/handling charges)
- 1 or MORE dollar $ Vouchers can then be applied to the Transaction total amount (after taxes/shipping/handling charges)
7. Accuracy of Information
7.1 Michael Rossy Ltée will make all reasonable attempts to ensure that the information relating to the loyalty «rewards +» program and the benefits related to such program is accurate and complete, but Michael Rossy Ltée and its officers, directors and all employees will not be responsible for any information made available through the program that is not accurate or complete, including but not limited to, errors, delays in providing program benefits. Members will be solely responsible for any reliance upon such information through their participation in the program. All members by registering to the program agree that it is the responsibility of each member to monitor any changes to the information and material in connection with the loyalty program and its benefits.
7.2 Michael Rossy Ltée will make all reasonable attempts to ensure that the information being handled by its 2 partners Salesforce and Summit Tech is handled with the upmost accuracy and security. 8. Intellectual Property
8.1 «Rewards +» and Rossy Rewards + and the two "R" logos in red and blue, as well as, other trademarks and logos referred to in connection with this loyalty program, are registered and common law trademarks of the Michael Rossy Ltée corporation and trademarks and logos under the Canadian and Province of Quebec laws. Participating in our program does not authorize anyone to use any such trademarks or logos without Michael Rossy's prior written consent.
8.2 The Michael Rossy Ltée organization is the sole owner of all the copyrights and all other intellectual property rights in content, images and information in connection to the «rewards +>. program and its material. Rossy does not authorize you to copy, reproduce, transmit, distribute any such content, images, logos or information of any kind without Michael Rossy's prior written consent.
9. Limitations of Liability
9.1 Michael Rossy Ltée and its respective officers, directors and all employees will not be held liable for any malfunctions of the loyalty «rewards +» program, system or website failure, liability for any expense, loss, cost, injury, damage, accident or any other harm or matter whatsoever, however suffered or caused (including direct, indirect, incidental, special, punitive, consequential, exemplary damages or damages for loss of income or profits) directly or indirectly arising out of or related to a member's participation in the «rewards +» program or any other consequences thereof. Further, Michael Rossy Ltée accepts no liability for any damages or loss arising from the termination, variation, amendment, suspension or in any other ways relating to the «rewards +» program, in whole or in part, including any additions, corrections, modifications or deletions of the program and its benefits or other benefits and features, with or without notice, except for any liability that cannot be excluded by law.
9.2 To the extent permitted by law, the member hereby agrees to release and hold harmless the Michael Rossy Ltée Corporation and all its officers, directors and employees from any claims, liabilities or damages related to participation in the loyalty «rewards +» Program, including without limitation, any claims arising from or related to the receipt of any loyalty program benefits.
9.3 Michael Rossy Ltée is not responsible for any internet traffic congestion, technical problems, website issues or combination thereof, including any damages to any computer, programs, software or injuries resulting from participating in or downloading any material relating to the loyalty «reward +» program or otherwise accessing our website.
10. Applicable Law and Jurisdiction
10.1 For all our members residing in the province of Quebec, all our «Terms» shall be governed by the laws of the Province of Quebec and the laws of Canada applicable therein.
10.2 For all other members outside of the province of Quebec, the terms and conditions shall be governed by the laws of Canada, unless the laws of each of the member's province of residence require that the laws of that province govern, in which case, the laws of such province will govern.
10.3 The invalidity or unenforceability of individual contractual provisions shall not affect the validity of the remaining contractual provisions. In such case, the effective or unenforceable provision shall be replaced by the parties by an effective or practical new provision.
10.4 Any applicable federal, provincial and local taxes connected to the issuance or acceptance of our «rewards +» program benefits are the sole responsibility of the member. The Rossy Organization will not be responsible for any tax consequences which may flow from participation in the program.
